1.Introduction

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, APIs and related services offered under the Aetherisz name by Aetheris (together, the “Services”). By creating an account or using the Services you agree to these Terms.

Some Services have additional service-specific terms. Where they apply, they supplement these Terms, and if there is a conflict the service-specific terms govern for that Service only.

2.Definitions

“Account” means the registered profile you use to access the Services. “Content” means text, files, prompts, code, images and other material. “User Content” means Content you submit. “Output” means Content generated by the Services in response to your input, including AI-generated Output.

“Credits” means prepaid balance used to pay for metered usage. “API Key” means a secret credential issued to call Aetherisz APIs. “Applicable law” means the laws that apply to you and to us in the relevant circumstances.

3.Eligibility and Age Requirements

You may use the Services only if you can form a binding contract under applicable law, or if a parent or legal guardian has agreed to these Terms on your behalf where the law permits. Some features, such as payments, developer tools and health-related information, may require you to be an adult.

You may not use the Services if you are barred from doing so under applicable law, or if we have previously terminated your Account for a serious breach.

4.Creating and Managing an Account

You must provide accurate information when you register and keep it reasonably up to date. You may not create an Account on behalf of someone else without authority, or create Accounts by automated means.

If you use the Services for an organisation, you confirm that you are authorised to bind that organisation, and “you” includes that organisation.

5.Account Security

You are responsible for keeping your sign-in credentials, devices and API Keys confidential, and for activity under your Account that results from your failure to do so. Tell us promptly if you suspect unauthorised access.

We use protective measures including Aetherisz+ verification, rate limits and anomaly detection. These measures reduce risk but cannot eliminate it.

6.Acceptable Use

You must use the Services lawfully, respectfully and in line with the Acceptable Use Policy, which forms part of these Terms.

We may set reasonable usage limits to protect the stability and fairness of the Services, and we will make material limits visible where practical.

7.Prohibited Activities

You must not: break the law; infringe the rights of others; distribute malware; attempt unauthorised access; bypass verification, rate limits or billing; scrape or overload the Services; resell access without permission; impersonate others; or use the Services to harass, defraud or harm anyone.

Nothing in these Terms prevents lawful security research or responsible vulnerability reporting conducted under applicable law and our Security & Vulnerability Reporting policy.

8.User Content

You keep whatever ownership rights you have in your User Content. You grant us a limited, non-exclusive, worldwide licence to host, process, transmit and display your User Content only as needed to operate, secure and improve the Services for you, and to comply with law.

You confirm that you have the rights needed to submit your User Content and that it does not violate these Terms or applicable law.

9.User Responsibilities

You are responsible for your use of the Services and of Output, including decisions you make based on it, compliance with laws that apply to your activities, and obtaining any permissions needed from people whose data you submit.

10.AI-Generated Content

Some Services generate Output using AI models operated by us or by third-party providers. Output may be inaccurate, incomplete, outdated or offensive, and similar inputs may produce different Output. The Aetherisz AI Terms apply to AI features.

As between you and us, and to the extent permitted by law, you may use Output you lawfully obtain, subject to these Terms and the rights of others. Output may not be unique and may not be protectable by copyright.

11.Accuracy and Reliability Disclaimer

Information provided through the Services, including search results, encyclopedic answers, calculations, predictions and AI Output, is provided for general information. It is not legal, medical, financial or other professional advice. Verify important information with a qualified source before relying on it.

12.Third-Party Services

The Services rely on and may link to services operated by others, such as authentication, payment, hosting and AI providers. Their own terms and privacy policies may apply. We are not responsible for third-party services we do not control, except where applicable law provides otherwise.

13.Search Results and External Websites

Search results and links may point to external websites. Inclusion does not mean we endorse, verify or control that content. Your use of an external website is governed by that website's terms.

14.Intellectual Property

The Services, including software, design, documentation and branding, are owned by Aetheris or its licensors and are protected by intellectual-property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

15.Aetherisz Trademarks and Branding

“Aetherisz”, “Aetherisz+”, “Aethel”, “axopedia” and related names and logos are brand identifiers of Aetheris. You may not use them in a way that suggests sponsorship, endorsement or affiliation without written permission, except for accurate, non-misleading references.

16.Software and Platform License

Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable licence to use the Services for their intended purpose. You must not copy, modify, reverse engineer or create derivative works of the Services except where applicable law expressly permits it.

17.API and Developer Usage

Use of Aetherisz APIs is also governed by the Developer & API Terms. API Keys are confidential, are tied to your Account, and must not be embedded in public client code or shared. Usage is metered and rate limited.

18.Credits, Not Subscriptions

Aetherisz currently sells prepaid Credits and does not offer subscriptions or automatic renewals. The Credit Purchase Terms explain how Credits are bought and used. If subscriptions are introduced later, their terms will be published before they are offered.

19.Free and Paid Services

Some Services are free, some require payment, and some include free allowances such as promotional Credits. Free Services and allowances may change or end. Paid features are available as described at the time of purchase.

20.Payments

Prices are shown in Indian Rupees unless stated otherwise and may include or exclude taxes as indicated at checkout. Payments are processed by third-party payment providers. You authorise us and our provider to charge your selected payment method for purchases you confirm.

21.Refunds

Refunds are not automatically guaranteed. Refund requests are evaluated case by case under the Credits Refund Policy. Nothing in this document limits any rights that cannot legally be excluded or waived under applicable law.

22.Cancellation

Because there are no subscriptions, there is nothing to renew or cancel. You can stop using paid features at any time. Cancelling a purchase that has already been completed is handled as a refund request under the Credits Refund Policy.

23.Service Availability

We work to keep the Services available but do not guarantee uninterrupted or error-free operation. The Service Availability policy describes maintenance, outages and changes.

24.Maintenance and Changes

We may add, change or remove features, models or integrations. Where a change materially reduces a paid feature you have already purchased, we will act fairly, which may include notice or a proportionate remedy where required by law.

25.Suspension and Termination

We may suspend or terminate access if you seriously or repeatedly breach these Terms, if required by law, or to protect users, the Services or third parties from harm. Where reasonable, we will give notice and an opportunity to respond, unless doing so would create risk or is legally prohibited.

You may stop using the Services at any time.

26.Account Deletion

You may request deletion of your Account. The Data Deletion & Account Closure policy explains what happens to your data, including information we must keep for legal, security or accounting reasons.

27.Privacy

Our Privacy Policy explains how we handle personal information. By using the Services you acknowledge that your information will be handled as described there.

28.Security

We use reasonable technical and organisational safeguards appropriate to the Services. No system is completely secure. Report vulnerabilities through the Security & Vulnerability Reporting policy.

29.Disclaimers

To the extent permitted by applicable law, the Services are provided “as is” and “as available”, without warranties of any kind beyond those that cannot be excluded by law. See the Disclaimers page for details. Nothing in this document limits any rights that cannot legally be excluded or waived under applicable law.

30.Limitation of Liability

To the extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential losses, or loss of profits, data or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us for the relevant Service in the three months before the event giving rise to the claim.

These limits do not apply to liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence where such limitation is prohibited.

31.Indemnification

Where legally applicable, you agree to compensate us for reasonable losses and costs arising from third-party claims caused by your breach of these Terms or misuse of the Services. This does not apply to consumers where the law prohibits such terms.

32.Dispute Resolution

Please contact supportaetheris@gmail.com first so we can try to resolve concerns informally. If a dispute cannot be resolved, it may be brought before the competent courts described in the Governing Law section, without affecting any right you have to approach a consumer forum or regulator.

33.Governing Law

These Terms are governed by the laws of India, without overriding mandatory consumer protections of the country where you live. Your rights may vary depending on applicable law and your location.

34.Changes to Terms

We may update these Terms. For material changes we will give reasonable notice, for example by email or an in-product message, before they take effect. The Policy History page lists published versions. Continued use after the effective date means you accept the updated Terms.

35.Severability

If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain in effect.

36.Entire Agreement

These Terms, together with the policies they reference and any service-specific terms, are the entire agreement between you and us about the Services and replace earlier understandings on that subject.
